Several groups opposed to the Google Book Search settlement filed with the court notes outlining their concerns on Tuesday, the last day of such reviews will be accepted.
As expected, lawyers, Microsoft, Electronic Frontier Foundation, a coalition called "Open Book" Alliance blew up the deal as anticompetitive and detrimental to consumers. A brief "Open Book" Alliance compares the Google Book Search settlement of the modern version of a cartel involving John Rockerfeller's Standard Oil and railroad industry, which ultimately led to the Sherman Act's antitrust laws.
Google is trying to get the final approval of its settlement with book publishers and authors grant him the rights to digitize some books out of print. In October, Judge Denny Chin of U.S. District Court for the Southern District of New York will consider the arguments for and against the settlement, which has inspired hundreds of pages of reading material for Chin examine before the hearing.
Gary Reback, who helped prosecute Microsoft for anticompetitive behavior in 1990, the author briefly open book of the Alliance. "Google, and the plaintiff publishers secret negotiations during the 29 months prior to horizontal price-fixing combination, produced and supported by the monopoly of the distribution of digital books. Their wickedness had cleared most of the field in the digital distribution of books, protecting it from Google meaningful competition."
Microsoft, now find themselves on the same side of the issue as Reback, argued in a brief that Google should not get permission to scan copyrighted books in the class action settlement. "The proposed settlement goes far beyond the legitimate role of copyright lawsuit - settlement of a claim for a violation - and places a slew of provisions that would restructure the rights and remedies available copyright holders all over the world," Microsoft said in its brief.
Google argues that anyone who wants to digitize books, may enter into transactions with the Secretariat of the book rights, created under the settlement, but at the moment the company is the only organization in the world licensed to scan and display the books that came out of the press, but still protected by copyright laws. Google plans to install some of these books (copyright holders can choose how much Google is allowed to show) in the Google Book Search product and will also provide access to books through public libraries and kiosks institutional subscriptions are sold at universities and research libraries.
Computer and Communications Association filed a note in support of the proposed settlement of Google. "Over the past 20 years, I have devoted my career to fight against monopolies, and this settlement is not alone. This agreement will increase competition in the online sales of books, and books among themselves, "said Ed Black, CCIA president and CEO, in a statement.
And over the Bank Holiday weekend, Google has agreed to provide European authors and publishers place at the table. However, an umbrella group with the EFF, the American Civil Liberties Union, as well as several authors skeptical about the intentions of Google.
"Google Book Search and other digital projects The book will review the way people read and study," said author Jonathan Summer in a press release distributed by the EFF. "Now is the moment to make sure that the Google Book Search is a privately owned, as the physical world of the book.
Google has updated its privacy policy for Google Books last week after he was drafted to provide more detailed information, but some groups do not think it goes far enough. Google stated that the release of the full privacy policy for Google Books settlement is approved and once the company runs all aspects of the service.
